Summary

Review of the Homestead Acres LLC and Turning Point Development LLC draft contract zone agreement.

A public comment period will not be included.

ACTION: Schedule Public Hearing.

Description

The ordinance requires the Council to approve the draft conditions and restrictions for the proposed contract zone agreement for 40 plus acres on the west side of Route 100 in the Village Mixed Use District prior to the Planning Board hearing.  The Council will review the draft as presented by the Developers and determine whether or not it is sufficient to refer to the Planning Board.  Substantive changes to conditions and restrictions will require additional hearings. A copy of the draft agreement and its associated exhibits is attached below.

The Council must also make findings that the agreement meets the statutory requirements for contract zoning prior to approving an agreement.  Consideration of the findings will occur at the same meeting where the agreement is considered.  A copy of the draft findings is also attached for informational purposes. 

Staff is familiar with the packet of information and has worked closely with the Developer during the past couple of weeks. Due to the submittal date of this most recent draft, staff have not had adequate time to prepare a review memo.  It is anticipated that staff comments will be prepared prior to the meeting.
