Summary

Introduction of an amendment to the Falmouth Zoning Map to rezone a portion of property from BP to VC1. 

A public comment period will not be included with this item.

Description

As mentioned in a previous agenda item, the new owners of the Falmouth Shopping Center would like to construct outdoor sports fields on a portion of their property that lies within the BP District.  Outdoor sports fields are categorized as “outdoor recreation facilities” under the Zoning and Site Plan Review Ordinance.  This use is allowed as a conditional use in the VC1 District but is prohibited in the BP District.  The developers are requesting an amendment to the Zoning Map to rezone the portion of their property where they would like to construct the playing fields from BP to VC1 to accommodate their proposal.

Attached are an ordinance introduction letter and a marked-up copy of the developer’s most recent Conceptual Master Plan showing the existing zoning district boundary (in blue) and the proposed approximate zoning district boundary (in red). 

In addition to the standard Town Council public hearings required by the Town Charter and the standard MRA hearing before the Planning Board, this proposed zoning map change requires extra notification procedures per Maine statute.  More specifically, all public notification must include a copy of the proposed zoning map changes and all direct abutters must be notified of the change by first class mail.  Prior to sending out these public notices, the precise boundaries of the proposed zoning boundary change must be established.  The developer will be required to submit a surveyed plan with metes and bounds showing the proposed zoning boundary change.
