Summary
Order to acquire property rights relating to the Route 100 Project.
A public comment period will be included with this item (3 minutes per person).
ACTION: Council action is anticipated.
Description
In order to construct the Route 100 project improvements as designed, the Town needs to obtain certain property rights. At the October 10, 2018 Council Meeting, the Town Council executed the required Notice of Intent to Acquire Real Property Rights. This action was needed in order to proceed with acquiring property rights through the eminent domain process. The notice was then posted at various public locations and an officer’s return notice was executed and returned to the Town Council Chair. These actions are also required as part of the eminent domain process.
The action scheduled for this meeting is to vote to acquire said rights as defined in the Notice of Intent, which is attached for reference.
If the proposed order is moved and approved by the Council, the property rights will transfer to the Town upon filing the order at the Registry of Deeds, which is scheduled for October 24, 2018. This will allow for the project to be advertised, also scheduled for October 24, 2018.
