Summary

Introduction of an amendment to the Zoning and Site Plan Review Ordinance section 3.18.11, in order to extend the Tidewater Master Plan Development District for another 10 years.

Description

The Tidewater Master Plan Development District was approved by the Town Council in April of 2005. Section 3.18.11 of the Zoning and Site Plan Review ordinance reads as follows: 

If the Town Council grants approval of a Master Development Plan, the applicant’s legal rights, duties or privileges determined thereby, shall expire if the development is not commenced within two (2) years of the date on which approval was granted and shall expire as to any portion of the development that is not substantially completed within ten (10) years of the date on which approval was granted. The Council may extend these time limits upon showing by the applicant that additional time is needed due to required local, state, or federal permits or approvals, or because of market conditions.

While the residential subdivision and two of the Village parcels have been fully developed, parcels TF-1, TF-2, TV-3 and TV-4 remain to be built out. Tidewater, LLC, has therefore requested that the Council extend the expiration date of the district from 10 years to 20 years, to allow them time to develop the remaining parcels.
