Summary

Discussion about a possible easement that would permit the owners of property located at the corner of Hat Trick Drive, Clearwater Drive and Farm Gate Road to construct certain improvements for the benefit of the property owner and the general public within the Hat Trick Drive right of way which portion is owned by the Town of Falmouth.

A public comment period will not be included with this item.

ACTION: Council action is not anticipated.

Description

The owners of property located at the corner of Hat Trick Drive, Clearwater Drive and Farm Gate Road are currently before the Planning Board with a site plan application to construct a restaurant. The Planning Board is likely to require a sidewalk, pedestrian lighting, landscaping, stormwater management and possibly on street parking within the property owned by the Town and known as Hat Trick Drive. The proposed improvements are consistent with what was proposed to the Town Council earlier this spring during an ordinance amendment process. 

Property rights (granting or receiving) can only be approved by the Town Council. This discussion agenda item is meant to offer the Town Council an opportunity to comment on the proposed terms in an easement to be developed at a later date. If the Town Council is generally agreeable to the proposed conceptual terms of an easement, staff will work with the property owner and Town Attorney to finalize an easement that will require a Town Council order at a later date. 

A copy of the applicant’s most recent site layout is attached.  (Please note: It is believed that this plan will be amended to take into account feedback received during the Planning Board review process.)
