Summary

Update from staff regarding possible development of one or more large solar array projects on town land and/or buildings and order to appoint a Town Attorney to assist the Town with the development of legal documents and partnerships to faciliate the use of federal tax credits related to solar projects.

Description

In the most recent Legislative session, Falmouth provided testimony in support of LD 1263 which would increase sizing limits and smart metering options for municipal projects. Although this legislation has not yet been adopted, the Town believes that there are options that could both save electricity costs for the Town and rely on a reliable renewable energy source.

The Town recently hired an engineering firm, Woodard and Curran, to provide the Town with high-level energy screening options. Combined heat and power as well as large-scale solar were analyzed. At this time, staff would like to pursue solar options at several municipal sites and facilities. The Town is also engaging with a local solar installer to evaluate best options for site location. Once the Town has determined best site locations, conducted a technical feasibility analysis and a return on investment analysis and reviewed permitting challenges, it is hoped that a viable option will be available. The most cost efficient method to fund a project is through the utilization of federal tax credits. While the Town is not eligible to receive tax credits, it can develop partnerships with private investors who are eligible for tax credits. Creating this partnership will require legal expertise which is why staff is recommending the Town Council appoint Ben Lund, with the firm Brann & Isaacson. Attorney Lund has experience developing these partnerships including a project in Falmouth at the Maine Audubon property.
