Summary
Order to authorize the Town Manager to execute an easement that will grant 469 Doten, LLC (developer of a proposed restaurant known as Rivalries) access to Hat Trick Drive, a town owned property, for access to their property at the corner of Clearwater Drive, Farm Gate Road and Hat Trick Drive.
A public comment period will be included with this item (3 minutes)

Description
The developer of the property located at the corner of Clearwater Drive, Farm Gate Road and Hat Trick Drive has recently received site plan approval to locate a new restaurant. The property owner would like to access the new restaurant from Hat Trick Drive, which is Town owned property but not a traditional public way. Although the public has the right to travel on Hat Trick Drive, the property ownership of this road does not automatically allow curb cuts and access to private property.
The attached easement will allow access to the private property in question and will include an annual fee which the Town will pass through to Falmouth Shopping Plaza, the party responsible for maintaining this town property. The agreement requiring the Falmouth Shopping Plaza to maintain Hat Trick Drive was part of a multi party limited partnership agreement approved by the Town.
