Summary
Order to authorize the Town Manager to execute an agreement that will require 469 Doten, LLC (developer of a proposed restaurant known as Rivalries), to reimburse certain expenses associated with the construction of Hat Trick Drive in exchange for an easement to access Hat Trick Drive.

Description
The developer of the property located at the corner of Clearwater Drive, Farm Gate Road and Hat Trick Drive has recently received site plan approval to locate a new restaurant. The property owner would like to access the new restaurant from Hat Trick Drive which is town owned property but not a traditional public way. Although the public has the right to travel on Hat Trick Drive, the property ownership of this road does not automatically allow curb cuts and access to private property.
The attached agreement will require the private property owner to reimburse the Town for certain expenses associated with the construction of Hat Trick Drive in exchange for an easement to access Hat Trick Drive.
