Summary

Order to authorize the Town Manager to enter into an agreement with the Portland Water District for the Construction, Financing and Operation of Mill Creek Pump Station and Ancillary Force Mains in the Town of Falmouth. 

A public comment period will be included. (3 minutes)

ACTION: Council action is anticipated.

Description

The Town of Falmouth will be constructing a new pump station at Mill Creek and ancillary force mains. The Town desires to construct, finance and operate this part of the collection system through a cooperative agreement with the Portland Water District (PWD). This agreement will allow the Town to gain access to reduce rate bond financing through the PWD and the Maine Municipal Bond Bank. During the twenty year bond financing period, PWD will own the new infrastructure. The Town will continue to operate and maintain the new infrastructure as if it were the owner. At the conclusion of the twenty year financing period, PWD will convey the ownership of the infrastructure to the Town.

There are several other actions that need to be considered by the Council so that construction can commence later this spring. Those actions include the following:

March 14 – accept an easement from Heidi Almy and Douglas Schnapp for a residence on Depot Road, so that the Town can locate the force main between Depot Road and Route 88, running along Mussel Cove Road. This easement will be held in escrow until other actions are taken on March 28.

March 28 – reject an easement from the Mussel Cove Home Owners Association (HOA) that is intended for bicycle and pedestrian access from the residential subdivision to private commercial property located on US Route One. The HOA has negotiated a tentative agreement with the Town to accept another easement on condition that this easement is rejected.

March 28 – accept an easement from the end of Mussel Cove Road to the property line of Heidi Almy and Douglas Schnapp where the Town previously accepted an easement. This easement will allow for the placement of utilities and future bicycle and pedestrian connectivity.

March 28 – accept Mussel Cove Road as a public street.

March 28 – order to appropriate $1,000,000 from unassigned sewer enterprise fund balance to reduce the amount needed through bond financing via the PWD March 14 agreement.
