Summary

Presentation from the Community Development Committee (CDC) of an outline for enabling legislation for contract zoning.

A public comment period will not be included.

Description

Based on direction at the June 20 Council meeting, the CDC have generated a draft outline and now seek feedback from the Council prior to completing the final language.  The CDC relied on the legal memo from the Town Attorney as well as samples from multiple Maine communities to develop their approach.  CDC Chair King will give a short overview and point out specific elements of policy that will be of interest to the full Council.  Those include, as examples, the areas of town where contract zoning would be permitted and the procedures for the review and approval of a contract.  Documents included are:

History

  • Princeton Properties recently purchased Foreside Estates on Clearwater Drive and made a presentation on May 25 to the Council expressing an interest in expanding the development.  The Council directed staff to present zoning options to support this development request.
  • The Council, at their June 20 meeting, discussed the recommendation of staff to develop enabling legislation for contract zoning, a method of zoning permitted by statute that the town does not currently have in its Zoning and Site Plan Review Ordinance.  This option gives authority to the Council to allow variations to existing districts with the use of a contract agreement.  The development of enabling legislation for contract zoning was referred to the CDC.
  • The CDC has met three times (July 5, 13 and 20) since June 20 in an effort to have a draft outline and final amendment language to the Council at the earliest opportunity.
