Summary

Description

This item was introduced at the Council's August 8 meeting.  A copy of the proposed language, a letter of introduction, a memo from the CDC, and comments from the Planning Board MRA hearing are attached.  The draft language has been modified in a non-substantive way to clarify language and submittal items.

History
The Council, at their June 20 meeting, discussed the recommendation of staff to develop enabling legislation for contract zoning, a method of zoning permitted by statute that the town does not currently have in its Zoning and Site Plan Review Ordinance.  This option gives authority to the Council to allow variations to existing districts with the use of a contract zoning agreement.  The development of enabling legislation for contract zoning was referred to the CDC.

•    The CDC met three times (July 5, 13 and 20) since June 20 in an effort to have a draft outline and final amendment language to the Council at the earliest opportunity.
•    The Council discussed the draft outline at their July 25 meeting and requested the CDC finalize the language.
•    The CDC met on August 2, 2016 to complete the draft.
•    The CDC introduced the amendment on August 8, 2016.
•    The CDC met on August 11 and 30 to finalize the amendment language for hearings.
•    The Planning Board held an MRA hearing on September 6, 2016.
•    The Council hearing was held on September 12, 2016.
•    The CDC met on September 13, 2016 to review the hearing comments.
