Summary

Ordinance to amend the Zoning and Site Plan Review Ordinance Sec. 19-23.11 Master Development Plan Time Limits, in order to extend the Tidewater Master Development Plan an additional one year.

A public comment period will not be included with this item as public comment was taken at an earlier date.

ACTION: Council action is anticipated.

Description

Town Council to consider an ordinance to extend the deadline of the Master Plan one year, to October 11, 2017.  The extension will maintain the current zoning for the district while affording Tidewater LLC the time to finalize all plans, legal documents, and zoning amendments associated with the requested changes to the Master Plan in a manner that meets all the objectives originally outlined by the Council in May 2015.

A letter of introduction from Councilors King and Hemphill and the proposed amendment language are attached.

History:
The original Master Development Plan was slated to expire in April 2015.  At that time there were four development sites that were not developed. As part of the requested extension of the Tidewater Master Plan, Tidewater LLC requested changes to the current provisions for those sites.  In May 2015 Tidewater LLC and the Council agreed on conceptual changes to the Master Development Plan and related documents.  A Council sub-committee was formed to review the proposal and provide Council oversight for the finalization of amendments necessary to implement the changes.  This sub-committee and staff have responded to several submittals by Tidewater LLC and have not yet determined that all documents are in the proper format for integration in the ordinance and meet the May 2015 conceptual agreement.

  • Third extension granted April 11, 2016 to October 12, 2016.
  • Amendment introduced August 11, 2016.
  • Public Hearing held September 12, 2016 by the Town Council.
  • MRA Hearing held October 4, 2016 by the Planning Board.
