Summary

Resolution to permit Avesta Blackstone, LP to proceed with its Planning Board review for a proposed senior housing project at Squidere Lane.

Description

Avesta Blackstone LP (Avesta) is proposing to create 19 additional affordable senior housing units at its property located at 21 Squidere Lane, for a total of 39 units. After considerable research Avesta and the Town have determined that there may be some ambiguity regarding the status of Squidere Lane as a town way. In order to create clarity, Avesta proposes to deed its interest in Squidere Lane to the Town in order to confirm Squidere Lane’s status as a Town street. Avesta has also requested that the Town discontinue the existing cul-de-sac located on its property in order to be able to develop the additional units and has agreed to waive any claim for damages resulting from the discontinuance. Avesta will provide the Town with a new turnaround easement on its property, as well as enter into an agreement with the Town to provide winter maintenance to Squidere Lane. 

Avesta requires subdivision and site plan approval for its proposed development and needs to show sufficient right, title or interest in the property to proceed with its application before the Planning Board. Town staff has reviewed the proposed street dedication and discontinuance of the cul-de-sac and finds the proposal acceptable. 

The attached resolution will allow Avesta to proceed with its Planning Board review and shall be considered evidence of Avesta’s right, title or interest in the cul-de-sac area that is proposed to be discontinued, for purposes of proceeding with Planning Board review of the project.  The resolution allows for the Town Council to make final approval at a later date regarding the street acceptance, discontinuance of the cul-de-sac and proposed maintenance agreement.
