Summary

Order to authorize the Town Manager to execute an option agreement to purchase a fifty foot wide strip of land between Route One and Clearwater Drive for a future public road. 

A public comment period will be included with this item (3 minutes).

Description

The owner of Foreside Estates has recently indicated interest in developing additional housing units on its property that is accessed from Clearwater Drive. The Town Council's Community Development Committee (CDC) has been working with the property owner on a contract zone proposal. Part of the CDC recommendations include the construction of a new road between Route One and Clearwater Drive. This road would provide alternative access to Route One where there is just one access point now, at the intersection of Clearwater Drive and Route One.

There is a 50 foot wide water line right of way (ROW) that could be used for the new road. Staff researched the ownership rights of this ROW and found that there are three entities having an ownership interest:

  • Portland Water District has a ROW easement and it includes a water main. The District has indicated that it would be willing to work with the Town and does not expect any compensation as long as its water main is not disturbed.
  • Emery Waterhouse is the owner on the Clearwater Drive end. It  has indicated that its sees potential value of a road in this area and it will consider granting rights to the Town, pending future development scenarios. 
  • The third owner controls the underlying fee ownership for the area closest to Route One. They are willing to convey their interests to the Town for $20,0000. The attached is an option agreement to acquire the property. There is a site plan attached that shows the varying ownership rights of the ROW. 

Stantec conducted an engineering feasibility study for the Town, looking at whether permits can be obtained and providing an opinion of cost to build the road. The results of that study are also attached. 

The option agreement will only be exercised if a contract zone is agreed upon by the owners of Foreside Estates (Princeton Properties) and the Town.
