Continuation of Discussion about Noise and Dust Ordinances as Related to Construction.
Description
At the September 29, 2020 meeting, the Ordinance Committee asked staff to draft an ordinance setting time parameters around construction activity of 7:00 am-7:00 pm, Monday-Saturday with Sundays off. The draft ordinance language is attached.
At the September 29 meeting, the Committee asked staff to consider the practicality of adding four additional dust control provisions to the Town’s regulatory structure while wanting to also make sure that industry standards/best management practices (BMPs) are being followed and wanting to allow staff discretion. The attached Maine Department of Environmental Protection (MDEP) handbook includes the industry standard for erosion and sedimentation control, including dust control. The handbook also addresses all of the suggested provisions with the exception of placing speed limits on construction traffic within private development sites. The Falmouth Code of Ordinance requires that development projects comply with the handbook. Staff have drafted the attached noise and dust control brochure which includes speed reduction recommendations.
