Summary
Order to exchange a small portion of land between the Town of Falmouth (Falmouth Nature Preserve) and Don Oaks of 176 Foreside Road, conditioned upon necessary approvals from the Nature Conservancy.
A public comment period will be included (3 minutes).
ACTION: Council action is anticipated.
Description
The current property owner purchased this property within the past year. A survey of the property revealed that the pool house encroaches upon the required 10 foot side setback by approximately one foot. The property owner has requested consideration for a land swap with the Town. The land swap would include the town granting the property owner 266 square feet on the side property line in exchange for 266 square feet (property owner to the Town) in two locations (front and rear of the property).
The Town land is know as the Nature Preserve. This property includes restrictions that would need modifications approved by the Nature Conservancy. The property owner has consulted with the Nature Conservancy and they appear to have no objections with the land exchange.
