Summary

Introduction of an amendment to the Zoning and Site Plan Review Ordinance section 3.18.11, in order to extend the Tidewater Master Plan Development District an additional six months.

A public comment period will not be included with this item.

Description

The Tidewater Master Plan Development District was approved by the Town Council in April of 2005. Section 3.18.11 of the Zoning and Site Plan Review ordinance reads as follows:

If the Town Council grants approval of a Master Development Plan, the applicant’s legal rights, duties or privileges determined thereby, shall expire if the development is not commenced within two (2) years of the date on which approval was granted and shall expire as to any portion of the development that is not substantially completed within ten (10) years of the date on which approval was granted. The Council may extend these time limits upon showing by the applicant that additional time is needed due to required local, state, or federal permits or approvals, or because of market conditions.

While the residential subdivision and two of the Village parcels have been fully developed, parcels TF-2, TF-3, TV-3 and TV-4 remain to be built out. Tidewater, LLC, has therefore requested that the Council extend the expiration date of the district an additional six months, to allow them time to discuss with the Council a plan for developing the remaining undeveloped portions of the Master Plan.

  • Letter from applicants detailing the request which also includes a request that is not applicable to this agenda item but it is applicable to Agenda Item 4. The portions of the attached letter pertaining to this agenda item includes numbers 1, 2, and 3. Although the letter requests an extension deadline of 10 years, the developer is aware that the introduction shortens the request to six months with the intention to give the Council more time to discuss the longer term future of the Master Plan with the developer. It is anticipated that a longer term extension will be considered by the Town Council within this proposed and initial six month extension.
