Summary

Order to discontinue a portion of Squidere Lane and to authorize the Town Clerk to execute the Certificate of Discontinuance.

ACTION: Council action is anticipated.

Description

In May, 2016, the Town Council approved a zoning amendment to facilitate the expansion of the Blackstone Apartments on Squidere Lane and discussed and conceptually approved changes to the legal status of Squidere Lane necessary for the development to proceed. Since that time, the developer has received their site plan approval from the Planning Board, and the the Town's attorney has worked to finalize the details of the proposed discontinuance. 

Street discontinuance is a unique, two-part process governed by State statute.  At their January 9, 2017 meeting, the Council completed the first step: adopting an order to approve the petition for street discontinuance and holding a public hearing on the proposed discontinuance.  At that same meeting, the Council also authorized the Town Manager to execute a Warranty Deed and Road Maintenance Covenant and Agreement in order to clarify the status of the remaining portion of Squidere and the responsibilities of each party for its upkeep and maintenance.

The order attached to this agenda will complete the second step of the process - formal discontinuance of the portion of Squidere Lane indicated in the attached Exhibit A.
