Summary

Ordinance to establish a new moratorium on retail marijuana establishments and retail marijuana social clubs.

Description

In May 2017, the Council enacted a moratorium that prohibited retail marijuana establishments and retail marijuana social clubs as defined in the Marijuana Legalization Act. This moratorium granted the Town 180 days to review and establish policy for land use and licensing. The Council established an ad-hoc subcommittee to study the issue and make recommendations to the Council.  The committee has met regularly since then, but needs more time to develop their recommendations.

In July, the Maine Municipal Association issued new sample moratorium language to address retail marijuana.  Both MMA and the Town Attorney have recommended that, instead of extending the current moratorium, the Council replace it with this new moratorium language. This moratorium will take effect retroactively to the date of introduction and will run for 180 days. The Council would have the option to extend it for an additional 180 days, if necessary.
