Summary

Public Hearing on an ordinance amendment to Section 19-23.11 of the Code of Ordinances relative to extending the time limits for development under the Tidewater Master Development Plan for one additional year.

Description

The Tidewater Master Development Plan was adopted in 2005 and is one of several regulatory documents that govern development within the Tidewater Master Planned Development District.  One of those documents, the Tidewater Master Development Plan, was initially scheduled to expire in 2015, however, five extensions of the Master Plan have been approved over the past three years.  This proposed zoning amendment would extend the timeframe for allowing development in certain areas of the zoning district governed by the Master Plan for one additional year.

The Town and Tidewater LLC, the property owner of “use areas” TF1, TF2, and TF3 as depicted on the Master Plan, have been working over the past several years to update the regulatory documents related to the zoning district.  In 2015, general agreement was reached on conceptual changes to the regulatory documents.  A Council subcommittee (Councilors Hemphill and King) was formed to review the proposal and provide Council oversight for the finalization of amendments necessary to implement the changes.  That review process has not yet been completed, so another extension of the Master Plan is being requested.

  • May 2015 – Council and Tidewater LLC agree to conceptual changes to the District
  • Second Master Plan extension granted September 16, 2015 to April 11, 2016
  • Third extension granted April 11, 2016 to October 12, 2016
  • Fourth extension granted October 12, 2016 – October 11, 2017
  • Fifth extension granted October 11, 2017 – October 22, 2018
