Summary

Public Hearing on an ordinance amendment to rescind Ordinance Number 82-2018 related to the Conditional Rezoning granted to Verizon Wireless per Section 19-17 of the Code of Ordinances.

A public comment period will be included with this item (5 minutes per person).

Description

On January 22, 2018 the Town Council granted a Conditional Rezoning to Verizon Wireless, Inc. to allow the placement of a Tier III Personal Wireless Service Facility (a wireless tower) on certain property (Map/Lot #R04-022) off Falmouth Road.  In February 2018, Verizon submitted an application to the Planning Board, however, the application was never processed by the Board. 

Verizon has now indicated that they no longer have interest in constructing the wireless facility and that they are abandoning this project.  Accordingly, they are now requesting that the Town Council rescind the Conditional Rezoning granted to them on 1/22/2018. If the Council rescinds the Conditional Rezoning, the property will revert back to its former status and be governed solely by the underlying Farm and Forest District zoning.

This amendment was introduced on January 28, 2019.  Attached, please find Verizon’s written request to rescind the Conditional Rezoning, an introduction letter, and the Conditional Rezoning Order approved by the Council on 1/22/2018.
